plea agreement

my brother inlaw is looking into to taking a plea agreement the agreement is that he does 18 months jail time this is in michigan will he have to do the full time or just half like indiana conserned sister

Under Michigan's "truth in sentencing" law, a defendant sentenced to prison must serve the full minimum term set by the judge. No good time reduction. So, if the sentence was 18-60 months, he'd have to serve the 18 months before being paroled. One exception to this would be if he was eligible for a boot camp placement, but that's too technical to answer here with the sparce information you provided.

Indiana may not have a law like T.I.S., and there might be a standard "parole after serving 50%" rule. We don't have that any more. Read more about the T.I.S, law at www.prosecutingattorney.info ... click on Legal Definitions ... scroll down to the "T"s.

If he was sentenced to a county jail term, he'd face only 12 months jail maximum and could get good time reductions, and maybe even early release beyond that due to jail overcrowding.
