Legal Question in Criminal Law in Michigan

My son was at his girlfriends house over the weekend. She lives with her mother still. They were in her room playing video games when a knock on the door was the police. They entered the room and said they smelled Marajuania and searched the room. The police found Marajuana in a dresser and charged my son and the girlfriend with possision of Marajuana and Use of Marajuana. They arrested my son and the girlfriend without reading them their right or telling them the charges. My son says it wasnt his. What can i do? or what can i do to help him?

The most likely circumstance is that the mother called the police, and consented to the entry and search. As the above posted, the officer was not required to mirandize your son, the lack of miranda will only make his statements at that time inadmissible.
