Legal Question in DUI Law in Michigan

When I was 17 years old i got an MIP. I went through the diversion program, and completed my probation, community service and alcohol class. They then said it was expunged off my record.

I now attend college at Western Michigan University. The other night I was at a party and the police came. They gave me an MIP for just being at the party, without giving me a breathalizer or finding any alcohol on me. Will I be able to fight this? Also will they be able to see that I had an MIP when i was younger?

I am going to school to be an elementary teacher and I can not have this on my record! What should I do?

If you admitted that you were drinking to the officer, no further evidence is needed. If you denied drinking, you may have be able to get your charge dismissed.

In any event, you should be still eligible for HYTA which would leave you with no record... EXCEPT prospective teachers are now required to divulge all past convictions and the examiners can pierce HYTA to find convictions if you fail to disclose them.

I'd get a lawyer if I were you. An absolute dismissal would put your mind at ease and avoid the chance of you wasting your education and your future.
