Legal Question in DUI Law in Michigan

I got a drunk driving when I was 18 and one when I was 21. I was given a OWI 1st for both. I got another one a year ago, Nov. of 08. 9 years after my last one. Between that time I recieved 2 driving on suspendeds about 8 years ago. I refused the breath test so they took my blood. Because of the refusal I got an atomatic suspension. I fought the suspension for refusal and the officer didnt show up so I was able to keep my license, or so I thought. I was driving on a restricted license during this time because I never went down to the secretary of state appeals board to reinstate. Because of my restricted license I attomaticly lost my license even thou I was not yet convicted of the DUI. A whole bunch of bs you ask me. Anyways I didnt know this so I kept driving and got pulled over for 10 over about a month and a half ago and got arrested for DWLS. I was wondering if I can be charged with a DWLS 3rd offense or if its been to long to count the ones from 8 years ago.

Everybody knows that when your restriction ends, you must apply for a full license and pay the reinstatement fee. Otherwise, you have no license.
