Legal Question in DUI Law in Michigan

Failure to appear years ago

I heard about this site and thought I could gather some information for my brother-in-law. He got a DWI in 1989 in NC..plead guilty, then another one in 1992 in IN�plead guilty no jail time, and then in 1995 he got another one in MI. He never went to court for the charges in MI b/c when he consulted with a lawyer, she told him he would definitely do jail time. He freaked out at the thought of that and just never went to court. He knows there has to be a warrant out for him, but he is so scared of the thought of going to jail that he just has never done anything about the last drunk driving. If he turns himself in, what could he be facing? He has a nice job, family/children, hasn�t drank in years, etc., I know this doesn�t matter in the courts, but I know that is way he has stayed �on the run�. I want to help him get things straighten out, so I want to know what he could be looking at. Thanks!

You don't tell what county your brother has charges pending in. That would matter. He should DEFINATELY be speaking with an experienced criminal lawyer. Call 1 8005766035.

Because of the fact that he has absconded for so long, the chances are that his bond is going to be set fairly high. He should definitely hire an attorney to help him through the process.

In what county is your brother charged? The sad fact is that he is potentially looking at jail time; however, if he turns himself in voluntarily he can avoid the very high bond that he will surely get if he is arrested. Moreover, the prosecutor may have a more difficult case now that it is 11 years later.
