Hi, my fiancee and i are ending after 3 years, we have a 4 month old son together. We are both on the lease for the home that we rent. I want him to move out, and i am willing to split custody with him, but I know that this will be messy. What is the best way to go about it while covering all the bases. He also has a drinking problem and I have had to call the police on him once while i was pregnant, and again just a few days ago. I did not file charges, but can I use this in a custody hearing if need be? Is there anything i can do immediately to get him out of the house?

Yes this can be used in a custody hearing. The first thing that you will need to do is start a custody proceeding in circuit court. I would advise that you retain an attorney for this. Since you are both on the lease then you both have equal rights to live there. The best thing to do would be to talk it out and come to a solution rather than waste time in court. However, if you leave and your name remains on the lease then you will be liable to pay for the rent if he does not make the payments. So make sure that you get your name off if you leave.
