Legal Question in Family Law in Michigan

custdy

I am a father of two special needs boys from Michigan. My wife and I are separated not devoiced living in the same house. We were thinking of filing for the divorce but she became pregnant with another mans baby. And was thinking of marriage to him and taking my boys, but hear is the problem. He is convicted of criminal sexual conduct 2nd degree (person under 13) and has to spend life on the list for sex offenders when he is done with his probation. I am not going to let that man be anywhere near my kids. Can I file for a restraining order now or after the devoice? Should I file for one? What kind of rights to his child (from my legal wife) dose he have?

Re: custdy

What kind of restraining order? against whom? You need to file for custody of your children, and probably his child too since she is legally yours... You are in for an uphill legal battle and this is not the forum to discuss your options.
