Legal Question in Family Law in Michigan

Ownership of house after death of ex-husband

After 29 years of marriage, my ex and I finalized our divorce on 6/12/07. We both agreed (which is stated in the divorce decree) that my ex would stay in the house and that he was to be solely responsible for the mortgage and heloc loan payments.

We also both agreed that my name would remain on the deed and we are both listed on the mortgage insurance policy; if either one of us dies, the house loan is paid in full.

My husband has remarried. As of right now, his new wife has not moved into the house and retains a separate home. If something should happen to my ex will I have legal rights to the house since my name is still on the deed?

The house is in Michigan. Thank you.

Ownership of house after death of ex-husband

Yes unless the judgment says otherwise. However you should have your attorney review your judgment to determine the consequences of the remarriage of your ex.
