Legal Question in Family Law in Michigan

retirement benefits

I am the primary benefactor on my ex-husband's teachers retirement. There is not a contingent benefactor.

What is the Michigan Law affecting the circuit courts authorization to make retirement allowances under the state retirement system subject to court order divorce actions?

Re: retirement benefits

You deal with all retirement issues in the judgment of divorce. The circuit court judge has total authority to issue decisions regarding such matters. Then, a document called a QADRO is entered, signed by the judge and sent to the retirement fund. This tell sthem how to send the retirement money. If you have such issues, you should have a divorce attorney handle it. Bill Stern
