Legal Question in Family Law in Michigan

I was told that in the matter of termination of parental rights both parents, when it has been appealed all the way up to federal courts.. divorce cannot happen as they do not know if it's with or without the children. Would this be correct?

I would disagree. I would suggest that the divorce be filed as a DM--with minor children. Then in the final judgment refer to the underlying termination case regarding the children.
