Fmla

when two spouses work for same employer,can both employees use FMLA ?Our employer says NO!....a union rep.

It depends on the reason for the FMLA. If it is for the birth or placement of a child, you cannot both get 12 weeks.

The FMLA doesn't specifically say yes or no, BUT there is an exception for employers who would be heavily affected by anyone's use of FMLA time to deny leave.

It sounds like this is something to be negotiated.
