Legal Question in Insurance Law in Michigan

Insurance refusal to pay

I was in an auto accident (my vehicle only, my fault) in 1999 and my auto

insurance covered most of my medical bills and my loss of pay while I

recuperated. About 6 months after the accident they dumped me and I had to

get another insurer for my auto's. About 2 years after the accident I was

still receiving some medical bills from a doctor who treated me at the

hospital I was at for three weeks during my recovery and the 6 months of

therapy at the Traumatic Brain Injury center there afterward. The original

auto insurer is refusing to pay the recent billings from the hospital saying

that they don't believe the bill is related to the auto accident, however

the doctor that is submitting the bill is Neurologist who has an office at

the hospital and he treated me exclusively for the head injury caused by the

accident. All of this has been turned over to the hospital Accounts

Receivable supervisor to try to get it resolved, but I haven't heard back on

whether it's settled or not. If I continue to get billed by the hospital,

can I turn the auto insurance company over to a collection agency and how do

I do that? Is there anything else I can or should do?

Re: Insurance refusal to pay

You may have a cause of action against the insurance company for failure to pay an insurance claim. If the unpaid medical bills are substaintial you may want to pursue it.
