Legal Question in Employment Law in Michigan

Pay for extra training and certification

My wife works as a childcare provider for an independant facility.

She is paid an hourly wage and typically reaches 40 hours a week.

About 3 times a year her employer requires her to attend training seminars on weekends and after work so that they can continue to be licensed. The employer pays for the courses, but does not compensate my wife or her co-workers for their time. Sometimes it can be as long as 8 hours on a Saturday. My question is, should she be recieving pay for her time, and if so, what action should she take?

Re: Pay for extra training and certification

It depends upon whether the certification is personal to her or inures to the sole benefit of the center.

The nursing home is paying for her to be eligible to work there, so while it might be illegal to require her to attend a training, it is entirely legal for the employer to pay for the training and require all employees to attend,--if they want to remain employed.

Their option is to not pay anyone for training, yet require that they be certified in which case your wife would be on the hook for the entire cost.

The question is whether it is legal not to pay for her additional training, but the question might also be framed in terms of what happens if an employee takes the training that the employer paid for and moves to another center?
