Legal Question in Landlord & Tenant Law in Michigan

court judgement

i went to court almost 4 weeks ago over a judgement for rent owed. the judge set me up with 40 dollar a month payments to the landlady and ordered her attorney to stop garnishment as of that day. he was told to keep the first garnishment check of 133, but all other checks he has gotten was to be turned back over to me. it is now going on 4 weeks and he has never stopped the garnishment and is holding all my money. how long does he have as this is causing me extreme hardship as i only work part time. he will not cooperate when we call and ask him what is taking so long. what can i do..?

Re: court judgement

The best way to deal with this would be to go to court to enforce this. The landlord may not feel inclined to do anything if the judge isn't on her case about it.

I just wanted to add that if you have the court order saying that garnishment should stop, that you should give that to your employer and try and stop it on your end.

Re: court judgement

The appropriate hearing would be what's called a show cause / contempt hearing - a hearing requiring the person to show cause why they should not be held in contempt of court for disobeying a court order.
