Legal Question in Landlord & Tenant Law in Michigan

How much notice must they give me to vacate my apartment?

I am disabled, living only on Social Security ($1075 per month). For the last 8 months I have been living with my mother in an assisted-living facility, but for the past 3 of those months she has been in and out of the hospital so often that now we have been told by the facility's management that they just can't accommodate her needs anymore. My other siblings wanted me to live with her, and they have legal control of her finances, but now that she is being told she can no longer stay in the facility, they have told me that I must vacate the premises. They told me last Friday, May 25, that I must be out by this coming Friday, June 1. I know they gave me that impossible deadline because they don't want to pay the rent for June when my mother will probably never be coming back. But my name is also on the lease (they wanted me to sign it, as well, as another tenant when we first moved in) and I thought I would have, legally, at least 30 days' notice to find another place to live. With the holiday weekend, they left me 3 days to find another place, and I need to apply for Section 8 housing due to my situation. I was paying $300/month rent here; I talk to a Social Worker tomorrow. What are my rights?

Thanks!

Marion

You must be given a written notice. Since you have paid your rent, you should be given a 30 day termination of tenancy notice. Please visit my web site at www.attorneygraziani.zoomshare.com or call my office at two, four, six-0000 so that I can advise you of your rights in this matter.

Very Truly Yours,

Re: How much notice must they give me to vacate my apartment?

If you are on the lease, then they have to give you proper notice, in writing, and 30 days. And remember, your living situation is between you and the landlord, not your family.

If you cannot get it resolved amicably and they are insisting that you leave, please contact me and I will make a phone call on your behalf. 248.644.8771.

Thanks and good luck.
