Legal Question in Medical Malpractice in Michigan

settlement agreement

settlement agreement, for wrongful death, 72 thousand, forced by lawyer to accept this, but not received yet, was settled sept 16, 2002.. our lawyer is holding out because of medicare, he forgot to inform them, four years ago. what can we do before he really messes this up. we have not signed anything/ and he canceled our jury date, but we have not settled yet. does it cost to take him to a state bar, he has messed us up. since day one, we have all records, proving this.

It most likely is too late as far as your opposition is concerned. Depending upon the amount that has to be repaid to Medicaid, you may or may not have a malpractice claima against the attorney. Because you settled without taking into account the Medicaid money, chances are he did not take into account the medical bills when deciding what to settle the case for. When you find out how much has to be repaid to Medicaid, call me. I can help you decide whether to bring a claim against the attorney. Also, I would have to know who the attorney is so that I do not have any conflict of interest. Remember, you have two years to sue the attorney after he ceases representing you.
