Why is the claim being heard again?

I had to evict a tenant. At court she made a claim of personal injury ''due to mold'' causing permanant asthma.

The claim was dismissed. Now she is taking me to Circuit court for the exact same matter. I did not think that was legal. Also can I plead the 5th so I don't have to answer her crazy questions again, like I did in the L.T. case?

First of all, you are in way over your head handling this yourself. These mold cases can take off and cause lots of grief. If you have any insurance on the property, call the insurer and tell them to handle it. If you do not, get a lawyer. Some possible defenses would be that the matter has already been decided in the other case. These cases can get expensive if you need medical testimony, etc. You cannot take the 5th unless the answer may subject you to criminal responsibility. William S. Stern

You should immediately notify your insurance agent to defend the Circit Court action.
