Legal Question in Personal Injury in Michigan

My son's eye injury

On Jan 12, 2009 my son ran into a support beam in the middle of the isle at Lowe's. He busted his eye open pretty bad which needed 7 stitches. Is there some sort of Law that requires the beams to be another color or padded for the consumers protection if it is going to be in the center of the isle?

Re: My son's eye injury

There is a concept in Michigan tort law called open and obvious. If a reasonable person would have seen the hazzard could it be avoided. In this case, it sounds as if your son just didn't see the beam and ran into it. Unless there is some special aspect, you probably don't have much of a case.
