neibors dad tree fell on my house,my insurance co gave me$1800.00..minus $1000 deductable,can i sue to get my deductable back?

You can try (for example, in small claims court), but you're going to have to show some tort. The tree falling by itself might have been enough for the insurance company, but it's not necessarily enough to make the neighbor pay you the deductible. Spend 30 minutes with an attorney and find out what the law is in your area.
