Legal Question in Real Estate Law in Michigan

Quit claim deeds

I quit claimed my marital home over to my ex husband but my name is still on the mortgage because he claims he can't refinance right now. What happens if he passes away. Would i still have rights to the property or what would happen to it?

Re: Quit claim deeds

No. You would not have rights to the property, but you would still be obligated on the loan for it. Such is the reason why quit claim deeds should not be granted unless the loan is paid off or unless there is a contract to pay the mortgage that can be enforced.
