Legal Question in Wills and Trusts in Michigan

Father died in Michigan without a will

My father died in Michigan ten days ago without a will. I have a copy of his death certificate and his name is on my brith certificate. What rights do I have as his only daughter to whatever retirement, pensions, property, and real estate here and in other states he owned? More importantly what should I do now to ensure his sister, my aunt doesn't take everything? Thank you.

You need to probate his estate in the county in which you live. Hiring an attorney to represent you as the personal representative will protect many of your rights.

your fears are unwarranted as long as your dads assets were in his name only. Under Michigan probate, the child is the rightful heir to any probate assets. Visit www.kliszlaw.com to get started on this matter. Tim Klisz
