Legal Question in Wills and Trusts in Michigan

life insurance policy

I just wanted to know if my stepchildren can sue me for any life ins money that he left for me and our daughter if he passes away? he did include all four of them on the policy, but they will only receive a very small portion of it. he also has 2 stepchildren from a previous marriage {wife died} can they try and sue me also? they were not included in the policy. thanks so much for your time.

While you can be sued for anything, there are no grounds for them to sue you, unless he is mentally incompetent and he does not have the capacity to make an intelligent decision, at which time they could attempt to set aside the deal on the basis of undue influence or if he was mentally incompetent and you were in a "fiduciary" capacity. Otherwise, the fact that he decided to name you as the beneficiary in his policy is his business and they would lose. William S. Stern

Only those children or adults listed as beneficiaries under the policy will receive funds. So, the step children listed as beneficiaries will get the amounts designated under the policy.
