Release of Lien

My recently deceased father held a mortgage on my house. The mortgage amount was $155,000. My sister and I shared equally in his estate. I paid my sister 1/2 of the mortage amount thereby satisfying the lien. What do I need to do to have the lien released. We are currently probating his home, in Florida, that is selling for $38,000. His total estate was under $400,000. I live in Michigan and he lived in Florida.

A release of lien document or discharge of mortgage should be signed by the personal representative of the estate and recorded in the County register of Deeds office where your property is located. If you would like my help, please contact me at johntatone.com

It seems to me that the personal representative of your father's estate should prepare and record a discharge of mortgage.
