illeagally stopped

If I wqas illegally stopped an the officer said that it was a traffic violation shouldn't I get a ticket for the violation even though the officer said that I was DWI?

Not necessarily. Often they just give a ticket for the more serious offense and skip the lesser included offenses.

Often the prosecuting attorney will amend the charges to add more offenses later; so you might not be off the hook. Better not complain about it too loudly.
