Child Protection

My daughter is eight years old, has Oppositional Defiant Disorder and encopresis. She has bowel accidents on a daily basis. Our social worker wanted me to voluntarily place her in foster care to get her help, but I refused. Now, she has filed a case to take her away just because she has bowel problems. Is this a legal child protection case as she has told me? I live in Minnesota. Thank you.

It would be extremely unusual for chiild protection to step in unless there is a claim of neglect or abuse. It would appear from your post that they are attempting to claim that a failure to provide proper medical care is neglect.

It would seem, at least from a cursory inspection, that the case for the county is weak. However, we would have to review all of the facts.
