Legal Question in Family Law in Minnesota

I have a son and me and his dad have never been married. Nothing has ever been filed through the court system at all about custody. I am struggling where i am liviing now and want to move and take my son with me. can i do this without getting in trouble?

If custody has been determined, you may not relocate out of state without the other parents consent or a court order.

Even if custody has not been determined, relocating does not preclude the other parent from filing a custody action after the fact and seeking the return of the child to the forum state if that parent is exercising parenting time with the child.

In most cases, you would be wise to mediate a resolution or to speak to an attorney in advance of any move.
