Re: Legal Seperation VS divorce

A divorce ends the marriage; a legal separation does not. The process is very similar to divorce--a similar kind of petition is served and filed, except that the grounds you need to state in a separation petition is that "there is a need for a decree of legal separation" instead of "there has been an irretrieveable breakdown of the marriage." The court can provide for the division of property, spousal maintenance, etc. as in a divorce.
