Legal Question in Wills and Trusts in Minnesota

My daughters husband died 1 yr ago at the age of 25, no children. Her name is not on the mortgage but it is on the deed. She wants to refinance the mortgage but can get no anwers because of not being on the loan. They did not have a Will. What can she do? She does have a death certificate but that is not enough.

If her name is not on the title, a probate proceeding must be filed for her spouse's estate and the interest in real estate determined by untestacy statutes, which means, in most cases, transferred through the probate proceeding to her.
