Legal Question in Wills and Trusts in Minnesota

Probate or not?

My mother has recently passed. I had P.O.A. that has expired upon death. She has NO spouse or childeren under the age of 38.

She has very little in the way of assets. She has NO cash and the only 2 items of value are a Mobile home and a car. Both of these still have loans against them. How do I sell these items to pay off the loans and cover some of her other bills (such as the funeral costs).

The personal belongings can be dealt with.

You must commence a probate action and, as the estate's personal representative, you would have the power to determine the assets of the estate and pay off any liabilities.
