legal rights

i live in florida, my ex wife and two daughters 11 and 12 live in mississippi. i have visitation rights but have not been allowed ANY contact in 3 years by her or her husband....what can i legal do to see and talk to my girls?

In response, I do not practice law in MS, so this is not a formal legal opinion. I can tell you what I would do. I would get a lawyer in MS immediately. If you cannot afford one call MS Bar Association and inquire where to go for possible help. Or, on your own, if there is a court case already there as a result of the divorce, call the clerk of court and inquire of their procedures for filing a demand to enforce the Court's Order/Final judgment, or a motion to hold her in contempt of court. You may be able to file a handwritten letter to get before the judge.

I presume you have your reason for not taking action sooner. I submit kids need to know their parents and know they care. Its quite rewarding to be there for them in any way. The court may inquire as to why something wasn't brought on this sooner. This shouldn't preclude you from re-instating visitation, but it may effect the court's feeling on the urgency of this matter and possibly, your interests in the children.

If the case originally was handled in another state and she has lived there more than 6 mos., you need to file a certified copy of your final judgment with the court in her jurisdiction (there may be some other requirements to get it established there).
