Legal Question in Family Law in Mississippi

property

My husband has been arrested for writing bad checks. He left me a month ago and stole some old checks from a closed acct. The acct. was in my name only. he got arrested at this drug buddys apt. and his suv is still at the apt complex. I am not on the title of the truck but I am on the insurance as a driver and I am legally still married . I want to know if I have any rights to get the suv. Will it fall under community property because I dont want to get arrested for auto thief but I am afraid of what will happen if the truck stays there. it will be stripped down. There is a lien on this suv and I have been help paying the payments.

You have a right to protect marital property. Go get the vehicle. If you are prevented by anyone, including law officers, get a lawyer and go to court to get it.
