Legal Question in Civil Litigation in Mississippi

Small Claims Court

My car was rear-ended in a traffic wreck. My insurance co had to pay me because the other person's ins co wouldn't contact us. I had to rent a car while mine was in the shop. After 7 months, my insurance co finally sent me my deductible and $900 of the car rental. The car rental was $1352.83 and since I had to use a charge card, I have been paying a finance charge on that balance (total $69.65 so far). What can I do to get the balance of money I had to pay out of pocket, which totals $522.48? Would it be worth it to hire an attorney or go to small claims court?

Re: Small Claims Court

You can either sue in small claim court or settle with the other driver. If you settle with the other driver, you will need to coordinate the settlement with your insurance company because it will have a lien on the settlement.
