Legal Question in Business Law in Missouri
I was terminated June 5 because the St. Louis company I worked for dissolved the meeting production business unit I was in. The company now outsources those meeting production services to a company in Chicago. The company wants me to work on a project thru this outsource company, as an independent contractor because they will get a "kickback" from the outsource company. The client in question, who did run the business thru my old company, does not want to work thru the outsource company, but does want me to work on the job thru a different supplier. Am I bound by a non-compete contract when the company I worked for terminated me because of downsizing, and is no longer in the business that I would be performing?

Yours is aquestin that begs mor efacts, to give an answer with certainty. The fact that your termiantion was involuntary might negate the non-copete restriction. What yyour non-compete agreement actually says does matter. Consult directly with an attorney who can access to more of the facts, to get a clearer view of your options.
