Legal Question in Consumer Law in Missouri

I recently went to a automotive repair shop to get the motor controlling my windshield wipers replaced due to their unreliability. When I got my vehicle back my windshield had a substantial crack that was not there before. After asking the shop owner about it he then became angry and saying the crack was there before. He has refused to pay for the replacement of my windshield and was extremely rude when confronted with the cracked window. I plan on taking him to small claims court. After getting my windshield fixed I have found out that this happend frequently at more reputable places like O'Reilly's and they replace the windshield no questions asked. Also, through some research I have found out that what I was charged for my windshield wiper motor may be incorrect. Do I have a substantial enough case to file a claim?

If you were cheated, then you may bring yrou samll claims suit as you prososed. If you prevail, the judge may also grant you your filing and surcharge fees too. It is unclear whether the amount is significant enough to warrant filing in Associate Circuit Court. Perhaps you can meet directly with a civil attorney in your area, to evaluate your case. Many offer a low cost initial consultation.
