Legal Question in Credit and Debt Law in Missouri

Court cost

I live in the state of Missouri, I have a lawsuit against me on a Discover Card (that part I don't have a problem with) I have made arrangments with the law firm and already sent in first payment. I have been summoned to court and don't want to go or pay the court fees, is this something that is the law for me to pay and go to court? Any help will be appreciated. My court date is 3/12/08. Thanks

Re: Court cost

If you fail to appear the likelihood is that the other side will take a default judgment against you. Right now you may think you've entered into an agreement with the law firm, but if they go and they get a judgment against you, they can collect it by garnishing your wages, which may get you into trouble at work.

You are trusting the lawyer on the other side of your case to treat you fairly. His job, however, is to maximize the recovery for the creditor.

Many times there are defenses to these claims that you may not be aware of. I would urge you to contact an attorney in your local area for assistance.

Good luck.

Re: Court cost

If you were served with a summons, you must appear in court on your court date or have an attorney appear for you. If you don't, the other side will take a default judgment agianst you for the entire amount they claim is due plus attorney's fees, interest and court costs. The credit card agreement provides these terms. Don't let this happen. It is highly likely that an attorney can save you more money than the attorney will cost you, and a judgment against you will go on your credit report. Hire an attorney.
