if evidence is presented against an accussed defendent at a preliminary hearing without benifit of legal council is that past the critical point and a violation of due process

Why would someone charged with a felony ever appear at his or her preliminary hearing unrepresented by legal counsel? Obviously this would be an unbelievably serious mistake. If the person could not afford private counsel then it is likely that the court would appoint the public defender to represent the accused. In any event, the accused should hire legal counsel now if he or she is able to do so.
