Legal Question in Criminal Law in Missouri

My nephew was charged with growing and manufacturing, he didn't even go before a judge, they did his arraignment hearing via video, he did not have an attorney present, is that legal?

It is becoming very common for arraignments to be done via close circuit television. There is a camera in the jail. and the judge has a monitor at the bench in the court room. So, your nephew may have goen before a judge without physically standing before the judge. To my knowledge, no one has successfully argued that this violates any law or constitutionally gauranteed rights. You should hire good counsel to represnet your nephew, if he can't afford to do so himself. Use a public defender as a last resort.

Good Luck

Yes, arraigning defndants by video hookup is quite common. Your nephew needs to hire the best criminal defense attorney he can afford and as soon as possible. If he can not afford an attorney, he should request the Judge to appoint the public defender. Good luck.
