Legal Question in Criminal Law in Missouri

Pet dog
My son has a lab pup. When he returned home yesterday he found that the pup had taken some of my granddaughter toys out side and chewed them up. He punished the dog showing him the toys and smacked the pup on the behind. A neighbor felt this was abusive and called animal control. Animal control came to his home and stated since there was report of abuse they had to take the dog and have him check. Now they are telling him even after a vet cleared the dog of signs of abuse that he will have to go to court to get him back. Help
