Legal Question in DUI Law in Missouri

I know someone who had a terrible wreck..car flipped lucky to be alive.she was unconscience and taken to the hospital and ticket for a dwi but never blown for it....on the state patrol website they stated she was ticketed for this charge and another charge which was not true and was also arrested...which was not true..the small town local paper got wind of it and reported the same thing...she has never been in trouble before..good student..great family...is there any recourse for something like this..

My first piece of advice would be that this person should hire the very best criminal defense attorney that she can afford. Usually the law enforcement authorities have at lest some semblance of a reason to suspect drunk driving. Were there alcohol containers in the car? Did the driver exhibit any symptoms that could be taken to be alcohol related? In many cases the law enforcement people have blood drawn at the hospital for testing. There are far too many facts that we just do not know. A competent attorney may be able to sucessfully defend the charge, and then the driver may be able to get the local paper to print the whole story, not just the law enforcement version.
