Claiming life ins policy

My mother died in November of 2005,she had been residing in a nursing home for 3 years prior to death.She was a resident under the Missouri Medicaid system, as such not having any assets upon death. There was no probate because of no assets, i have come across a life insurance policy in which my father was named as beneficiary who preceded my mother in death. I am the only child/heir to my parents. The insurance company said it can only make the proceeds which are less than $5,000.00 out to the estate,but there was no estate as such and did not go to probate. How can i collect on this policy as sole heir.There was a will naming me as a benieficiary.

You may want to see a lawyer who deals with estate and trust issues to help you sort this out. Normally you have only 1 year to settle an estate, whether you go through probate or not. You should locate an attorney in Missouri who does this kind of work and have him or her help you with this issue.
