Legal Question in Family Law in Missouri

Need out of state procedure for divorce

I now live in Texas but, was married in Missouri where soon to be ex still lives. We have nothing to fight over such as kids or property. My question is can I get a divorce here in Tx? If no do I physically have to be in Missouri or can a lawyer represent me? Thank you

Re: Need out of state procedure for divorce

First, thank you for the opportunity to answer a common question.

YOU DO NOT HAVE TO GET DIVORCED IN THE STATE YOU MARRIED IN!

If you have lived in Texas for over 6 months and in the same county for over 90 days, then the State of Texas has jurisdiction to grant you a divorce.

If you live in the Housotn area, I have developed a "DO IT YOURSELF" divorce kit for people with no property, no debts, no kids and both parties agree to sign everything.

If you live in the counties around Houston, Texas, do NOT buy the kit sold at office supply stores! They do not contain the necessary wording or forms that the courts in this part of Texas require.

If you want to try to do it yourself, go to any local law library. They have the form books to assist you in doing the paperwork. It will take several hours and you will probably get a terrible head-ache but you will then understand why attorneys went to law school for 3 years.

I also offer a free phone consultation at 713-847-6000. Be sure to let us know that you found me on www.lawguru.com.
