Legal Question in Family Law in Missouri

Unpaid Child Support She refused

If the person you are supposed to be paying child support to refuses the payments and sends them back to the state. Then the state refunded it to me. Then a few years later wants the back child support. Do I owe the money between the time when she refused it, upto now. How do you pay child support to someone who won't accept it? I am aware I owe now that she has requested it again and am paying it. The support enforcment is telling me my rears are $11,000.00. And say they are going to report me to the credit bureaus if I dont pay it all now.

I dont want my credit hurt anymore if possible

Thank you

Re: Unpaid Child Support She refused

There is no law of which I am aware that releases you from a court ordered or administratively ordered child support obligation if the custodial parent refuses your payments. At the time that happened you should have hired an attorney, gone back to court and had the original child support order modified or terminated. The amount of child support you are considered to be behind with is called "arrears". It may be possible to negotiate with the division of child support or with your ex's attorney to do something about the arrearage. These types of cases often have very unfair results and nothing about them is easy. If you are in the Eastern part of the state and are not already represented by legal counsel you may call me for a free telephone consultation at 314-727-2822. I would be happy to offer my services to you for a reasonable fee if I can be of assistance.
