Legal Question in Civil Litigation in Missouri

Training Reimbursement Agreement Legality

I want to see how enforeable this contract is. My company required me to attend training and now is demanding payment. I want to see if there would be any consideration given to being required to take the training and for depreciation of it over time.

By his/her signature below, Employee acknowledges that during his/her Networks, Inc. employment, Networks, Inc. may require Employee to complete various types of training for the successful completion of Employee's responsibilities. To assist Employee in the completion of such required training, Integrated Solutions Group may pay for all related expenses regarding the training, including: traveling costs, hotel, and food expenses, tuition costs, and Employee's salary, should such training be held during an Employee's regular working hours. All training cost payments represent an advance against Employee's salary for a full twelve-month period after such training is completed. Should employee quit his employment with Networks, Inc., or go to work in a competitive field during the twelve-month period after completing any compensated training paid for by Networks, Employee will voluntarily repay Networks, Inc. all direct and related expenses regarding this training.

Re: Training Reimbursement Agreement Legality

If you agree to this you'll be bound and there is a possibility that the courts would enforce the agreement. Although I can spot a few problems with the agreement, they might or might not preclude a court from enforcing it against you.

I do not believe they can recover the cost of your salary if you quit. They might be able to recover the cost of your training, if you agree to it by signing this contract.

If I were your attorney, and I am not (no attorney client relationship is formed by your solicitation of assistance over the internet), I could not advise you to sign the agreement. In the end, signing would be your decision. But keep in mind that you are, in effect, becoming an indentured servant if you sign this agreement.
