Legal Question in Intellectual Property in Missouri

Too late for a trademark?

I started a club back in 1999 and never got a trademark. At the time I wasn't sure how well it would do and figured if someone started a club in another city with the same name it wouldn't make much difference. Well, the club's doing great and now club owners in two other cities are using the same name. Furthermore, the duplicate names are causing confusion for people searching for us on the Web. Is it too late to get a trademark?

No. Use in the marketplace provides TM protection to an extent, but you should also register.
