Time Clock Problem

My employer installed a time clock on a computer and quite a few of us forget to clock in or out, so they instituted a policy that if you dont clock in, you don't get paid, even if they know you are there. This is a small business, so they really do know if you are there. Is this legal. How can they not pay you when everybody knows you were there working.

The easy answer is -- Clock In. If your paycheck depends upon it, it is in your best interest to remember to clock in when you arrive at work in the morning. This does not seem to be an unreasonable request for employees that are paid on an hourly basis. If clocking in is too much of a burden, then you may want to consider finding a different job. You could also approach your employer to see if they would change the policy based upon whatever makes it difficult for you to clock in each morning. Now if they are making you clock out and back in for each bathroom break, or some similar requirement of clocking in and out several times a day (other than when you arrive, your lunch break, and when you leave for the day) then the answer may be different. However, your post did not indicate any unusual circumstances. Best of luck with your situation.
