The number of months that a landlord tolerates nonpayent of rent before filing suit vary between landlords. There is bo law agaisnt waitng a few months and then filing, or filing after rent is two days late. Most generally, unless there are other reasons to evict, rent is at least one month overdue before suit is filed.
