Legal Question in Medical Malpractice in Missouri

misdiagnosed non-hodgekin's lymphoma/pt.died

Pt. 5 yr's remission for Non-Hodgekin's Lymphoma. Has breathing, eating and airway distress. Treated for reflux. Then given anxiety pills. Cannot get Dr. to call back.Called exchange and they won't bother doctor. Finally, insisted on CT. Showed large mass around thyroid. Biopsy done by ENT showed no cancer. DX as Hashimoto's Thyroiditis. TSH levels are normal throughout. Yet another CT, radiologist declares ''given the aggressive appearance of this mass, pt. should be re-biopsied.'' Dr. ignores this and is ready to surgically remove thyroid. Pt. deteriorates. Daughter (nurse) insists she has cancer. They transport pt. to large hospital where biopsy is done again. Dx is Cancer. Pt. died a few weeks later. I have some of the records. They maybe should have biopsied her thymus, a prime spot for recurrence of lymphoma.

Re: misdiagnosed non-hodgekin's lymphoma/pt.died

I am very sorry for your loss. From what you are saying, it sure sounds like the doctors did not provide very good care. It also sounds like you are on the right track by getting the medical records right away. I would be happy to talk with you about your case and help you understand your options. Here is the most important advice I could give you. The laws in Missouri that govern cases like yours are going to change on August 28, 2005. The changes will be very detrimental to cases like yours. Here is the good news though. If you file your lawsuit before August 28, these new laws will not apply to you. To do that, an attorney must begin working on your case right away in order to get everything accomplished that needs to be done before filing a lawsuit. Therefore, regardless of who you call, contact an attorney immediately. Please feel free to contact me at [email protected] or (800) 962-5363. Good luck.

Jeff
