Legal Question in Personal Injury in Missouri

My daughter was involved in a school bus accident about a week ago and was taken to the emergency room, there she was diagnosed with a hematoma to her forehead and cervical strain. I have not been contacted by any insurance company I do not even have any of that information. It was the school bus driver's fault; he attempted to cross the highway and another vehicle struck the bus. The superintendent of the school told me at the scene of the accident to have all medical bills forwarded to the school but also told me it was not he bus driver's fault. The next morning I pulled the highway patrol report and it was in fact the bus drivers fault and the driver ws fired. A month ago the bus driver was coming down our road and ran my neice off the road and instead of turning the incident in to their insurance company they swept it under the rug and paid for the incident out of the districts own pocket, I feel like they may be trying to do this in this case. The newspaper stated that the superintendant stated there were no injuries to the students that were on the bus. What should I do to make sure this is handled fairly.

The short answer is to hire an attorney. Unless you have handled hundreds of injury cases, there is no way you can adequately move forward against the resources of an insurance company or state agency. The fact that the superintendant was not straight with you at the beginning should give you an idea of how this will play out if you let it. Remember, you only get one opportunity to make sure your family is treated fairly- don't leave it to chance!

DO NOT send the medical bills to the school if you have health insurance, even if it is Medicaid. Have your health insurance pay the bills, and keep your daughter's medical information private until you have to reveal it, at the end of the case when she is done treating. Also, get pictures of her injuries, and the bus if you can.
