Legal Question in Personal Injury in Missouri

Dog bite

My 6-yr-old daughter was bitten by my boyfriend's dog; a year and a half later she still has a scar on her face. He knew the dog had bitten a child before but did not tell me. Is that a reasonable matter for a law suit and how soon do I have to decide before time runs out?

You have a five year statute of limitations; your daughter is a minor, and she has until two years after her 18th birthday to sue. But these cases are generally easier to try if they are tried soon after the incident.

They say that every dog gets one bite. In other words, until the owner is aware that the dog is prone to biting, he has no duty to warn or take precautions. Here it sounds as if he knew, he just didn't take precautions. I hope he has insurance for this kind of thing. If he does not, you're not likely to be able to collect from him even if you prevail.

I would agree with Mr. DeWitt's general resopnse regarding the statute of limitations. There is also a theory of liabilty that may attached based on a premises liability claim. I have had success in these cases before and would be happy to discuss with you further.
