Personal injury case time line

How long does it typically take to settle a personal injury case? I have a lawsuit that has been with a lawfirm for six years and we have not even gone to trial yet!

Depends on the case, unfortunately. No lawyer should settle your case until your medical condition has stabilized, and sometimes this takes time. On the other hand, Missouri has a five year limitation period on tort cases, which covers most personal injuries. Hopefully, your case has been filed by now and is moving forward. Your attorney owes you a response when you ask how your case is proceeding- call or write him or her!

It really depends on the nature of the case, the number of defendants involved, the court system, a bankruptcy stay, etc. A whole host of things can delay a case from getting to trial. However, I would suggest speaking with your attorney to see what the delay is due to and asking if there is a current scheduling order or case management order which sets forth the discovery schedule and trial date. If none has been entered, see if a hearing for such can be set and get a trial date on the books.
